Emeryville ADU Guidelines Last Updated 04/05/20

The city government of Emeryville has updated its local zoning codes to comply with the State ADU mandate.
The California Building Code (CBC) 2019 is adopted.
Relevant state bill updates for SB13, AB68, AB881, AB670 are shown in green below.



Number of ADUs allowed:

Under state law, each single-family home may now create at least one Accessory Dwelling Unit (ADU). Owner occupied single-family properties may create one Accessory Dwelling Unit (ADU) and one Junior Accessort Dwelling Unit (JADU). Multi-family properties, per every four existing residential units, may create one Accessory Dwelling Unit (ADU), so long as the existing units were legally established.

Types of ADUs allowed:

Detached ADU, Attached ADU, Junior ADU are approved. Accessory Dwelling Units may be new construction or converted from existing space. JADUs must be converted from existing space.

Lot size:

Single family and multi-family residential properties will not be subject to the minimum lot size of the underlying zoning district or by ordinance for Accessory Dwelling Unit (ADU) projects. ~ Updated: State Law AB-68

ADU size:

Single-family and multi-family Parcels will be allowed to build up to 850 sq.ft. for a one bedroom ADU or up to 1,000 sq.ft. for a two bedroom ADU, regardless of the underlying zoning standards of the property. A JADU up to 500 sq.ft. is allowed. The minimum size of any living unit (including Accessory Dwelling Unit (ADU)s and JADUs) is 150 sq.ft. according to Califronia Residential Code. ~ AB-68

Setbacks:

Setbacks for a detached new construction Accessory Dwelling Unit shall be no more than 4 ft from the rear and side lot lines. No setbacks shall be required for Accessory Dwelling Units and Junior Accessory Dwelling Units converted from legally eastablished existing space. Attached new construction Accessory Dwelling Units and conversions from existing space to be expanded must comply with the setbacks of the underlying zone. ~ AB-68

Shape, materials and style:

A Secondary Residential Unit shall be compatible with the principal Single Unit with which it is associated in terms of form, materials, style, and other relevant design factors.

Height:

The ADU shall step down at an angle from a maximum height of thirty feet (30') at fifteen feet (15') from the rear lot line to a maximum height of fifteen feet (15') at five feet (5') from the rear lot line.

Number of Bedrooms:

Not specified by State Standards.

Ownership:

Between between 2020 and 2025, owner occupancy requirements will not apply to new ADUs. (applicable to new construction and conversion units) ~ According To SB13

Utility connections:

Sewer Lateral. A proposal to establish a Secondary Residential Unit shall comply with the provisions of Chapter 8 of Title 7 concerning sewer laterals, including replacement or upgrading of the sewer lateral if required.

Allowed Zones:

*** Beginning in 2020, according to state law, all residential zoning districts, including single-family and multi-family, are allowed to build Accessory Dwelling Units. ***

You listed the following zones and asked to confirm if ADUs are permitted in these zone: RH, RM, RMH, MUR, MURS, MUN. All of those zones are correct except for the MUN. ADUs are not allowed in the MUN zone because the MUN zone is “Mixed Use with Non-Residential.” See Section 9-5.1404 in the attached ADU regulations.
